Software Licensing

Custom software developed for enterprise clients comes with a perpetual, non-exclusive license upon final payment, unless otherwise stated.

API Usage Limits

Public APIs provided by DCS Technosis are subject to strict rate limiting to ensure 99.9% uptime for all tenants on the platform.

Client Responsibilities

Clients must ensure that all data injected into our systems complies with local regulations, and provide necessary access for CI/CD pipelines.

SLA & Uptime

We guarantee a 99.9% uptime Service Level Agreement for premium tiers, backed by automated multi-region failovers on AWS.

1. Agreement to Terms

By accessing or using the custom software platforms, APIs, or consultation services provided by DCS Technosis ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you are entering into these terms on behalf of an enterprise or corporate entity, you represent that you have the authority to bind such entity.

2. License Grants & Restrictions

Upon final execution of a Master Services Agreement (MSA) and full payment of all associated development fees, DCS Technosis grants you a perpetual, non-exclusive, worldwide license to use the compiled software binaries and delivered source code (if specified in your MSA).

Restrictions

  • You may not resell or sublicense the core proprietary framework components belonging to DCS Technosis.
  • You may not reverse engineer our hosted SaaS solutions or multitenant APIs.
  • You may not use our services to transmit malicious code, malware, or illegal content.

3. Service Level Agreement (SLA) & Uptime

We take reliability seriously. Enterprise tier customers are guaranteed a 99.9% uptime calculated on a monthly basis. Downtime is defined as a total loss of ability to connect to the primary production servers, excluding scheduled maintenance windows.

If we fail to meet our SLA, you may be eligible for service credits proportional to the downtime, as defined strictly in your individual MSA.

4. API Fair Usage Policy

Our REST and GraphQL APIs are powerful tools, but they must be used responsibly to protect the platform's stability.

  • Rate Limits: Standard API keys are limited to 1,000 requests per minute. Bursts exceeding this will result in a HTTP 429 Too Many Requests response.
  • Abuse: Automated scraping, looping recursive calls, or intentional payload stuffing will result in immediate API key revocation without warning.

5. Intellectual Property Rights

Any pre-existing intellectual property belonging to DCS Technosis (such as our proprietary authentication modules, base CMS frameworks, and internal libraries) remains the exclusive property of DCS Technosis. The custom business logic, UI designs, and specific architectures built exclusively for your company become your intellectual property upon final payment.

6. Limitation of Liability

To the maximum extent permitted by applicable law, DCS Technosis shall not be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, our services.

7. Dispute Resolution

Any dispute arising from these Terms shall be governed by the laws of India. Both parties agree to attempt to resolve disputes through binding arbitration in Jaipur, India, before resorting to litigation.
